Stormwater Polution Prevention Plans

Often referred to as SWP3’s, Stormwater Pollution Prevention Plans are a requisite part of Notice of Intent (to disturb land) filings, which constitute the application process for issuance of NPDES permits. The latter are now required for most development activities where one acre or more of land will be disturbed. Though generally administered by state agencies, these permits are a federal requirement. The SWP3 document defines the protection provided during the construction process to prevent runoff carrying pollutants, primarily, but not exclusively, silt from exposed soil. As such, even where an NOI is not required, municipalities will often require an SWP3 as part of the plan set.

The review process has required that plans address an increasing range of elements and phases of the construction process. Landplan’s engineers meet regularly with state officials to keep abreast of new developments, often participating with suggestions in the refinement of the process. Occasionally walking NOI applications through the process on a personal basis maintains the firm’s familiarity with requirements and speeds the approval process.
